Processing of personal data

Acting on the basis of Article 13 of the GDPR, we provide information on the principles of the processing of your personal data by PPHU “MASCORT 3” Miroslaw Marek, with a request to read them.

1. Who is the controller of your personal data?

The administrator, i.e. the entity that decides for what purpose and in what way your personal data will be processed, is PPHU “MASCORT 3” Mirosław Marek, whose registered office is located in Stanisławice 286, (hereinafter referred to as PPHU “MASCORT 3” or “Administrator”). You can contact the Administrator in writing, by post by writing to the address of the registered office, by e-mail to: centrum@mascort.com.pl or by telephone: 12/284-25-68.

2. What is the purpose and legal basis for the processing of your data by PPHU "MASCORT 3"?

The legal basis for processing your personal data is:

a) Article 6(1)(b) of the GDPR, stating that the processing of your personal data is necessary for the performance of obligations arising from contracts concluded with you or for taking action prior to the conclusion of a contract (if you are or will be a contractor of PPHU ‘MASCORT 3’) or

b) Article 6(1)(c) of the GDPR, stating that we need to process your personal data in order to comply with legal obligations incumbent on PPHU “MASCORT 3” (such as fiscal, accounting obligations) or

c) Article 6(1)(f) of the GDPR, stating that the processing of your personal data is necessary in the case of legitimate interests pursued by the Administrator or by a third party (if, for example, you are an employee of the contractor PPHU “MASCORT 3”, contact and cooperation with you is necessary in order to establish and implement the cooperation).

3. What rights do you have towards the Administrator regarding the processed data?

Please be advised that, in accordance with the GDPR, you have the right to access, rectification and erasure of your data, restriction of processing, the right to data portability, not to be subject to automated decision-making, including profiling, and the right to object to the processing of your personal data.

In doing so, however, we must inform you that if you object to the processing of your personal data and your data is deleted, it will not be possible to log on to our website and catalogue, which will make it difficult to establish or fulfil obligations under contracts concluded with you or your employer.

You can exercise the above-mentioned rights in the following situations, for example:

a) with regard to a request for rectification of data: when you notice that your data is incorrect or incomplete;

b) with regard to a request for erasure: in situations where you notice that:
– Your data will no longer be necessary for the purposes for which they were collected by PPHU “MASCORT 3”,
– when your data are processed unlawfully,
– data should be deleted in order to comply with a legal obligation;

c) with regard to a request for restriction of data processing: in situations where you notice that:
– Your data is incorrect – you may request the restriction of the processing of your data for a period of time to allow PPHU “MASCORT 3” to check the correctness of the data;
– Your data will be processed unlawfully, but you will not want it deleted;
– Your data will no longer be needed by PPHU “MASCORT 3”, but may be needed by you for the defence or assertion of claims, or you raise an objection to the processing – until it is determined whether the legitimate grounds of PPHU “MASCORT 3” override the grounds for the objection;

d) with regard to a request for data portability: in situations where you notice that the processing of your data is based on your consent or a contract and where this processing is carried out by automated means;

e) with regard to objecting to the processing of your personal data: in situations where:
– the processing of your personal data is carried out on the basis of a legitimate interest or for statistical purposes, and the objection is justified by the particular situation in which you find yourself,
– Your personal data is processed for direct marketing purposes, including being profiled for this purpose.

We would also like to inform you that you have the right to lodge a complaint in relation to the processing of your personal data by PPHU “MASCORT 3” to the supervisory authority, which is the President of the Office for Personal Data Protection (address: Office for the Protection of Personal Data, ul. Stawki 2, 00-193 Warsaw).

4. With whom do we share your personal data?

To the extent necessary, the recipients of your personal data are or may be entities to which the Administrator subcontracts the performance of activities that require data processing: employees of the Administrator, entities providing services: facility security, IT support and IT systems supply, payment system operators, payment operators, law firms, consulting entities.

We would like to inform you that your personal data is not and will not be shared with third parties, incompatibly and unrelated to the purpose of its processing.

Nor will they be transferred either to third countries, i.e. outside the European Economic Area (EEA), or to international organisations.

5. How long do we keep your personal data?

We keep your personal data for the time necessary for the performance of the contracts concluded with you or your employer, and afterwards for the purposes of:

a) performance of obligations arising from legal provisions, including in particular tax and accounting – for a period of 5 years specified by law,

b) pursuing claims in connection with the performance of the contract – until the final conclusion of the proceedings,

c) preventing abuse and fraud, statistical and archiving, for a maximum of 5 years from the date of implementation of the purpose for which your data was collected.

6. Do we process your personal data automatically (including through profiling) in a way that affects your rights?

Your data will not be processed by automated means, including profiling, without your separate consent.
